In a decision published today, the First Senate of the Federal Constitutional Court ruled that the provisions of the Climate Protection Act of 12 December 2019 (Climate Protection Act <KSG>) on national climate protection targets and the permissible annual emission levels until 2030 are incompatible with fundamental rights insofar as there are insufficient provisions for further emission reductions from 2031 onwards.
The 2023 climate protection programme adopted by the German government requires additional measures in order to achieve the national climate target of reducing greenhouse gas emissions by at least 65 per cent by 2030 compared to 1990 levels. This was decided today by the Federal Administrative Court in Leipzig.
